Compliance & CRA Officer – Franklin, TN

This non-exempt position reports to the Loan Processing Manager.

PURPOSE OF JOB

The Compliance Officer develops and administers all aspects of the Bank’s Compliance Management program with an emphasis on building relationships, soliciting cooperation and open collaboration with all team members. In addition, the Compliance Officer must possess proficient knowledge of mortgage lending and deposit regulatory compliance rules and requirements. This role is responsible for implementing policies and procedures necessary to maintain compliance with federal regulations, state laws, and internal policies and procedures. The CRA Officer is responsible for administering the bank’s Community Reinvestment Act program to ensure compliance with the requirements of the act.

JOB DUTIES AND RESPONSIBILTIES

Compliance 

  • Chairs the Compliance Committee
  • Prepares the Committee agenda for the periodic meetings
  • Gathers supporting documents to disseminate to staff members regarding Compliance issues or upcoming changes
  • Reviews Committee minutes
  • Designs, implements, tests, and certifies the compliance program
  • Develops a continual training and educational program to train the staff, management, and directors on issues pertaining to compliance.
  • Develops an internal audit program to self-audit different aspects of the compliance functions or engages an outside independent auditor firm
  • Performs an annual risk-based audit program to identify areas of the bank operations that need auditing and the frequency needed to perform the audit
  • Develops the compliance audit scope in light of a risk-based audit program and assist with screening outside independent auditors to identify the most qualified entity that can perform the audit
  • Makes recommendations to the Risk Officer regarding the outside independent auditor(s) and scope of each audit
  • Oversees and assesses new and existing products and business strategies to ensure compliance with the appropriate federal and state laws and regulations while balancing business concerns in both the Bank and Mortgage areas
  • Administers the Bank’s regulatory compliance program to ensure effective policies, procedures and processes are aligned with federal and state laws, regulations, and industry standards that govern Bank and Mortgage operations
  • Provides leadership and direction, as necessary, to coordinate document gathering and other preparation for audits and examinations, and assists Risk Officer in developing appropriate responses
  • Prepares periodic reports and communicates results of monitoring, audit, regulatory, and other compliance-related activities to the Audit Committee and the Board concerning the Bank’s level of compliance; including corrective action plans to alleviate violations and prevent re-occurrence
  • Assists in reviewing and / or revising forms and disclosures purchased from outside vendors for compliance with applicable laws and regulations
  • Works with legal counsel in developing contracts, forms, and disclosures that serve the needs of the Bank and comply with applicable laws and regulations
  • Ensures that consumer-related reports and requests for information from federal and state regulatory agencies are completed and filed on a timely basis
  • Assists the Bank and Mortgage Division in ensuring adequate controls and quality control processes are in place for early identification of issues and ongoing compliance with laws and regulations
  • Monitors, tests and reports compliance by performing sufficient and representative compliance testing throughout the Bank
  • Implements a mechanism for handling consumer complaints, including maintaining records regarding complaints, monitoring and ensuring timely and appropriate responses and resolutions to all consumer complaints
  • Responsible for approval of Marketing material
  • Provides expert advice, support and guidance regarding compliance initiatives and responds adequately to inquiries or refers inquiries to the appropriate department and exhibits the necessary follow through
  • Coordinates adequate training for all bank personnel and directors on compliance policies and procedures, statutes, regulations, and interpretations applicable to their respective function(s)
  • Maintains the Compliance Risk Assessment and continues to identify compliance risks and provides solutions to manage potential risks
  • Directs the development, implementation and monitoring of the Bank’s data management and reporting requirements for compliance with the Home Mortgage Disclosure Act and Community Reinvestment Act
  • Administers the Bank’s Policy Management Program

 CRA

  • Chairs the CRA Committee
  • Oversees the coordination and reporting of CRA-related loan originations, investments and services on an enterprise wide basis in compliance with the Community Reinvestment Act
  • Prepares reporting on the Bank's CRA performance, including reports on Lending (CD, HMDA, & Small Business), Investments and Services
  • Facilitates discussion and assists with generating ideas for filling the gaps if improvement of CRA performance is necessary
  • Assists in setting performance goals or benchmarks for loans, investments and services
  • Ensures the Committee understands the credit markets in the Bank’s areas, the competitive structure of the loan markets, the size and geographic distribution of those markets and how the bank compares to peer institutions
  • Monitors the Bank’s performance and suggests ways to improve performance when applicable
  • Assists in developing programs designed to meet management identified credit needs of the local communities
  • Assists in researching and identifying Community Development investment opportunities
  • Reports program performance as required
  • Ensures required information is available to the public upon request
  • Oversees necessary training to ensure bank compliance with CRA policies and regulations
  • Reports to Senior Management, on a quarterly basis, the results of lending, investments and services to maintain a satisfactory or better CRA rating

 Other

  • Promotes the bank’s products and services whenever possible; participates in bank sponsored events, networking and volunteer opportunities at every opportunity

  • Ensure that members of the compliance staff possess the necessary experience, education, training, and skills to properly conduct assigned duties
  • Conducts effective performance reviews and goal setting for Compliance staff members

JOB REQUIREMENTS AND QUALIFICATIONS

  • College degree with an emphasis in business or finance or equivalent professional experience preferred
  • Minimum five years’ experience in banking operations and/or risk, compliance or mortgage lending in a bank setting preferred
  • Certified BSA and Compliance Professional certifications preferred
  • Ability to analyze and interpret loan documents
  • Proficient knowledge of loan and deposit rules; and consumer protection laws and regulations that apply to the Bank’s business operations
  • Comprehensive understanding of the overall operations of the Bank including Mortgage
  • Ability to communicate effectively through writing, speaking and listening
  • Outstanding leadership and management skills
  • Proven ability to train and motivate staff by communicating clearly, understandably, and effectively
  • Ability to work well with and communicate with employees at all levels
  • Excellent researching skills related to compliance
  • Strong organization skills with attention to detail
  • Strong Microsoft Word and Excel skills and the ability to create and customize various reports
  • Demonstrate a commitment to accuracy and quality while meeting deadlines
  • Effective time management skills and the ability to work independently or in a collaborative team environment
  • Maintains education and professional expertise in banking regulations through attendance of job-related seminars, conferences and workshops and a thorough understanding of the Bank’s product areas
  • Maintains a professional image with public interaction
